These Terms of Service (the “Terms”) govern your use of tmbhaircare.com and any purchase you make through the website. The website and store are operated by TMB Hair care Supply, a Florida corporation, under the TMB Hair Care name. In these Terms, “TMB Hair Care,” “we,” “us,” and “our” refer to TMB Hair care Supply.

Please read these Terms before using the website or placing an order. By visiting the website, creating an account, or purchasing a product, you agree to these Terms and to the policies linked below. If you do not agree, do not use the website.

Our store is hosted by Shopify, which provides the ecommerce platform we use to sell our products. Shopify is not the seller of the products offered on this website.

1. Who May Use the Website

You must be at least the age of majority in your state or place of residence to make a purchase. If you allow a minor to use a product purchased from us, you are responsible for supervising that use and following the product label.

You may not use the website or our products for an unlawful purpose, violate any applicable law, interfere with the website’s operation, transmit malicious code, attempt to gain unauthorized access, or use automated tools to scrape, copy, or disrupt the website.

2. Product Information

We work to keep product titles, descriptions, images, ingredients, sizes, prices, and availability accurate. Packaging, labels, ingredient lists, and product appearance may change when a manufacturer updates a product. The product you receive may therefore have minor packaging differences from an image on the website.

Colors can also look different depending on your screen, lighting, starting hair color, hair condition, application method, and processing time. Images and shade names are guides, not guarantees of an identical result.

If the product you receive is materially different from the item ordered, contact us at support@tmbhaircare.com before using it.

3. Professional Products and Safe Use

Some products sold on the website are intended for trained salon professionals or require chemical processing, heat, gloves, ventilation, strand testing, patch testing, or other precautions. Product availability on the website does not mean that every product is suitable for home use or for every person.

Read the full label, ingredient list, warnings, and directions before use. Follow the manufacturer’s instructions. Do not use a product if you are allergic or sensitive to an ingredient. Stop use and seek appropriate medical attention if you experience a serious reaction.

We do not provide medical advice, diagnosis, or treatment. Information on the website is for general product information only and does not replace advice from a physician, dermatologist, licensed cosmetologist, or other qualified professional.

You are responsible for selecting and using products appropriately. We are not responsible for harm caused by ignoring label directions, undisclosed allergies or sensitivities, mixing products contrary to instructions, improper chemical or heat application, or use by an unqualified person when professional application is indicated.

4. Orders and Acceptance

Your order is an offer to purchase. An order confirmation means we received the order. It does not mean we accepted it. We accept an order when we begin fulfillment or send a shipping confirmation.

We may refuse, limit, or cancel an order before shipment when reasonably necessary, including because of inventory errors, pricing or listing errors, suspected fraud, payment problems, resale activity that violates an applicable program, shipping restrictions, or an incorrect address.

If we cancel a paid order, we will refund the amount charged for the canceled item or order to the original payment method. We may contact you using the email address or phone number supplied with the order.

5. Account and Checkout Information

You agree to provide current, complete, and accurate account, billing, shipping, and payment information. You are responsible for protecting your account credentials and for activity under your account.

Check your shipping address before submitting an order. Contact us as soon as possible if you find an error. We cannot guarantee that an address can be changed after fulfillment begins. Additional shipping costs caused by an incorrect or incomplete address may be charged to the customer where permitted by law.

6. Prices, Taxes, and Payment

Prices are shown in U.S. dollars unless stated otherwise. Prices and promotions may change without notice, but a change will not affect an order we have already accepted. Applicable sales tax and shipping charges are shown at checkout before payment.

We may correct a clear pricing or listing error before shipment. If that happens after payment, we will contact you and either honor the corrected order with your approval or cancel and refund it.

Payment processing is handled by Shopify and its payment providers. Your use of a payment method may also be subject to the provider’s terms.

7. Shipping and Delivery

Orders ship from our fulfillment location in Rockville, Maryland. Current shipping options, rates, and estimated delivery times are shown at checkout and explained in our Shipping Policy.

Standard shipping is $8 and is free for eligible orders over $75. The usual estimated transit time is 3 to 5 business days. Express shipping is $15 with an estimated transit time of 1 to 2 business days. These are estimates, not guaranteed delivery dates.

Carrier delays, severe weather, service interruptions, and other events outside our reasonable control can affect delivery. We will communicate known material delays when we can. Risk of loss passes as provided by applicable law.

Orders shipped within the United States do not require the customer to pay import duties or customs release fees to receive the package.

8. Returns and Refunds

Our Return and Refund Policy is part of these Terms. You may request a return within 30 days after delivery. To qualify, the product must be unused, sealed, and in its original condition and packaging.

Contact support@tmbhaircare.com before sending a return. Returns sent without prior authorization may not be accepted. The customer pays return shipping unless the item arrived damaged, defective, or incorrect. We do not charge a restocking fee.

Approved refunds are issued to the original payment method after the returned product is received and inspected. Shipping charges are not refundable unless required by law or the return resulted from our error.

Nothing in these Terms limits rights that cannot be waived under applicable consumer law.

9. Damaged, Defective, Incorrect, or Missing Items

Inspect your order promptly after delivery. If an item arrives damaged, defective, incorrect, or missing, contact support@tmbhaircare.com with your order number and clear photos of the product, packaging, and shipping label. Keep the product and packaging until we finish reviewing the claim.

We may replace the item, issue a refund, or provide another remedy required by law after verifying the claim.

10. Promotions, Kits, and Professional Pricing

Promotions, bundles, gifts, professional pricing, affiliate offers, and discount codes may have separate eligibility rules, dates, limits, or exclusions. Unless an offer states otherwise, discounts cannot be combined. We may end or change a promotion before an order is placed.

Professional pricing is available only to customers who meet the published eligibility requirements and complete approval. You may not misrepresent your credentials, transfer professional access to another person, or use a professional account contrary to its stated terms.

11. Subscriptions and Recurring Purchases

If we offer a subscription or recurring purchase, the price, products included, delivery frequency, renewal terms, and cancellation rules will be shown before you agree to subscribe. By starting a subscription, you authorize recurring charges to your selected payment method until you cancel.

You may cancel, skip, pause, or reschedule before the next charge in accordance with the Subscription Policy and the instructions provided with your subscription. We will send notice five days before a scheduled renewal charge. We do not make automatic product substitutions. We will give at least 15 days’ notice before a subscription price change takes effect.

Subscription benefits do not combine with coupons, affiliate discounts, or professional pricing unless expressly stated. Returns for subscription orders follow our Return and Refund Policy.

12. Authenticity

We stand behind the authenticity of products sold directly through tmbhaircare.com.

If you reasonably believe a product purchased from us is not genuine, contact support@tmbhaircare.com with your order number, photos, lot or batch information, and the reason for your concern. We will investigate. If we determine that the product is not genuine, we will refund the product price and any shipping charge paid for that item.

This commitment applies only to purchases made directly through tmbhaircare.com and does not cover products purchased from another seller.

13. Reviews, Messages, and Other Content You Submit

If you submit a review, photo, comment, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate to your experience. Your content must not be unlawful, deceptive, defamatory, abusive, infringing, or malicious.

You give us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit for length or formatting, publish, and display the content in connection with our store and marketing.

We will not change the meaning of a customer review or present fabricated content as a customer statement.

Do not send confidential information through reviews or public comments. We may remove content that violates these Terms or applicable law.

14. Intellectual Property

The website’s original text, design, graphics, logos, photographs owned by us, and other TMB Hair Care content are protected by applicable intellectual property laws.

Product names, brand names, trademarks, packaging, and manufacturer materials belong to their respective owners.

You may use the website for personal shopping and legitimate business purchasing. You may not reproduce, sell, publish, modify, or commercially exploit website content without permission from the applicable rights holder.

15. Third-Party Services and Links

The website may use or link to services operated by Shopify, payment providers, carriers, social platforms, and other third parties.

Their services are governed by their own terms and privacy practices. We are not responsible for the content or independent conduct of a third-party website or service.

16. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the website, you acknowledge that policy.

Do not use the website if you do not agree with the handling of your information described there.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis. We do not promise that the website will always be uninterrupted, secure, or error-free.

Products may carry warranties or guarantees provided by their manufacturers. Except for express promises stated in these Terms or on the website, we disclaim implied warranties to the extent the law permits.

Some states do not allow certain warranty exclusions, so these exclusions may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, TMB Hair Care and TMB Hair care Supply will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products.

Our total liability for a claim arising from an order will not exceed the amount you paid for the product giving rise to the claim, except where applicable law does not permit that limit.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or personal injury caused by negligence where such an exclusion is prohibited.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TMB Hair Care and TMB Hair care Supply from third-party claims, losses, or reasonable expenses caused by your unlawful use of the website, your violation of these Terms, or your infringement of another person’s rights.

This section does not require you to indemnify us for our own negligence, misconduct, or violation of law.

20. Changes to the Website and These Terms

We may update the website, product selection, or these Terms. The date at the top shows when the Terms were last revised.

Changes apply after they are posted and do not retroactively change an order already accepted, unless required by law or agreed with you.

Your continued use of the website after updated Terms are posted means you accept the revised Terms.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

Any dispute that cannot be resolved informally will be brought in a court with jurisdiction in Broward County, Florida, unless applicable consumer law gives you the right to bring a claim elsewhere.

Before filing a claim, please contact support@tmbhaircare.com and give us a reasonable opportunity to resolve the issue. This informal step does not shorten or waive any legal deadline.

22. Severability and No Waiver

If a court finds part of these Terms unenforceable, the remaining provisions will continue in effect.

If we do not enforce a provision once, that does not waive our right to enforce it later.

23. Entire Agreement

These Terms, together with the policies and order details presented on the website, form the agreement between you and us concerning your use of the website and purchases from the store.

If a specific promotion or subscription term conflicts with these general Terms, the more specific term controls for that offer.
